These Terms of Service (“Terms”) constitute a legally binding agreement between KDM Analytics Inc. (“KDM Analytics,” “we,” “our,” or “us”) and any individual or entity (“Customer,” “you,” or “your”) that accesses, purchases, or uses any software, digital product, or subscription-based service offered by KDM Analytics through its website or authorized distributors (collectively, the “Services”).
By purchasing, downloading, accessing, or using any KDM Analytics product or Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must not access or use our Services.2. Scope of Services
KDM Analytics provides software tools, analytics platforms, and subscription-based solutions designed to assist customers with cybersecurity and related analytical capabilities.
 All product descriptions, specifications, and availability information are subject to change without prior notice. KDM Analytics reserves the right to discontinue or modify any product or Service at its discretion.3. Account Registration and Security
Where account registration is required, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.
 KDM Analytics shall not be liable for any loss or damage resulting from unauthorized use of your credentials.4. Pricing, Payments, and Taxes
All pricing is displayed in USD and is exclusive of applicable taxes unless otherwise stated.
 Payment for products or Services must be made in full at the time of purchase through an approved payment processor. By submitting payment information, you authorize KDM Analytics (or its designated processor) to charge the payment method provided for all applicable fees, taxes, and renewals.
KDM Analytics reserves the right to correct pricing errors or discrepancies at any time and to refuse or cancel orders arising from such errors.5. Subscription Terms
5.1 Renewal and Cancellation
Subscription-based products automatically renew at the end of each billing period unless cancelled prior to the renewal date. Customers may cancel their subscription at any time via their account portal or by contacting KDM Analytics support.
5.2 Effect of Cancellation
Cancellation prevents future renewals but does not entitle the Customer to a refund or credit for any portion of an active billing cycle. Customers will continue to have access to subscription benefits until the end of the paid term.
5.3 Pausing Subscriptions
Where available, pausing a subscription temporarily suspends access to Services. A paused subscription does not extend or alter the existing billing or entitlement period. Renewal and expiration dates remain unaffected.
5.4 Entitlements and Software Updates
Customers who cancel or pause a subscription remain entitled to receive software updates and product support until the end of the current paid term. Once the paid period concludes, all access to updates, services, and entitlements will terminate unless the subscription is renewed.6. Non-Refundable Policy
All purchases of digital products, licenses, and subscriptions are final and non-refundable.
 No refunds, partial credits, or prorated reimbursements will be issued for unused time, early cancellation, or account inactivity.
 By completing a transaction, you acknowledge and agree that KDM Analytics is not obligated to provide any refund or exchange unless required by applicable consumer protection law.7. Software License Grant
Unless otherwise stated in a separate written agreement, KDM Analytics grants you a limited, non-exclusive, non-transferable, revocable license to install and use the purchased software for your internal business or personal purposes in accordance with the accompanying documentation.

All intellectual property rights, including copyrights, trademarks, trade secrets, patents, and proprietary technologies, in and to the Services remain the exclusive property of KDM Analytics and its licensors.
 Nothing in these Terms shall be construed as transferring any ownership rights to you.9. Data Privacy and Security
KDM Analytics collects and processes personal information in accordance with its Privacy Policy.
 By using our Services, you consent to such collection and processing as necessary for order fulfillment, account management, and compliance purposes.
 KDM Analytics implements commercially reasonable administrative, technical, and physical safeguards to protect Customer data but makes no guarantee of absolute security.10. Warranty Disclaimer
To the maximum extent permitted by applicable law, the Services are provided “as is” and “as available”, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
 KDM Analytics does not warrant that its software or Services will be uninterrupted, error-free, or secure, nor that defects will be corrected.11. Limitation of Liability
To the fullest extent permitted by law, KDM Analytics shall not be liable for any indirect, incidental, consequential, special, punitive, or exemplary damages (including loss of profits, revenue, or data) arising out of or related to the use or inability to use the Services, even if advised of the possibility of such damages.
In no event shall KDM Analytics’ total cumulative liability under these Terms exceed the amount paid by the Customer for the product or Service giving rise to the claim.12. Indemnification
You agree to indemnify, defend, and hold harmless KDM Analytics, its officers, directors, employees, and affiliates from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your violation of these Terms, misuse of the Services, or infringement of third-party rights.13. Termination
KDM Analytics reserves the right to suspend or terminate your access to any product or Service, with or without notice, if you breach these Terms or engage in unlawful or unauthorized activity.
 Upon termination, all rights granted to you under these Terms shall immediately cease.14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to conflict of law principles.
 Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the state of Delaware, unless otherwise required by applicable law.15. Amendments to Terms
KDM Analytics may revise these Terms from time to time to reflect changes in business practices, regulatory requirements, or product offerings.
 All updates will be posted on our website, and the “Last Updated” date will be amended accordingly. Continued use of the Services after such updates constitutes acceptance of the revised Terms.16. Contact Information
